These Terms of Service ("Terms") govern your access to and use of Burt's Studio (the "Service"), operated by Burt's Studio ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Burt's Studio is a browser-based tool for designing kitchens, closets, and similar spaces in 3D — placing cabinets, countertops, appliances, and finishes, and exporting plans. The Service is provided for design and visualization purposes.
You must be at least 18 years old to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.

You retain ownership of the designs and any assets you upload ("Your Content"). You grant us a limited, non-exclusive license to host, store, process, and display Your Content solely to operate and provide the Service to you. You are solely responsible for Your Content and for having the necessary rights to it.
This includes complying with the license terms of any assets you obtain from third-party libraries (such as Sketchfab or other model and texture sites) and import into the Service. Many freely downloadable assets require crediting their creator when used in materials you share or deliver — checking and honoring those requirements is your responsibility.
The Service — including its software, interface, cabinet and material catalogs, and the "Burt's Studio" name and branding — is owned by us and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. No other rights are granted.
The Service relies on third-party providers for hosting, data storage, and email delivery. Their handling of information is described in our Privacy Policy.
The Service is under active development and is provided on an "as available" basis. We may add, change, suspend, or discontinue features at any time, and we do not guarantee any particular uptime or that the Service will be error-free. We may set limits on usage or storage.
The Service is currently offered free of charge. If we introduce paid plans in the future, the applicable pricing and terms will be presented to you before any charge, and your continued use of paid features will be subject to them. If you are ever charged for the Service and are not satisfied, email us at support@burts.studio within 14 days of the charge and we will issue a full refund.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of Your Content, your use of the Service, or your violation of these Terms.
You may stop using the Service at any time and delete your account yourself from Account settings (or by contacting support@burts.studio). We may suspend or terminate your access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination (e.g., ownership, disclaimers, limitation of liability) will survive.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and where appropriate we may notify you. Your continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the United States and of the state in which we are established, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located there, unless otherwise required by applicable law.
